1. Acceptance of Terms

By accessing or using Guard Core ("the Service"), operated by Guard Core ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. These terms apply to all users, including individual developers, organizations, and any person who accesses or uses the Service on behalf of an organization.

2. Description of Service

Guard Core is a security monitoring and threat detection platform for API applications. The Service provides:

• Centralized collection and aggregation of security events from distributed API applications
• Real-time monitoring of attack patterns, suspicious requests, and anomalous traffic
• IP intelligence, rate limiting analysis, and automated threat response coordination
• Security dashboards, historical trend analysis, and alerting capabilities
• Agent-based integration for collecting security telemetry from your FastAPI deployments

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice provided to active subscribers.

3. Accounts and Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including any two-factor authentication secrets and recovery codes. You agree to notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms or pose a security risk to the platform or other users.

4. Acceptable Use

You agree not to:

• Use the Service to facilitate attacks against systems you do not own or have authorization to test
• Attempt to gain unauthorized access to the Service, other user accounts, or connected systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in violation of any applicable law, regulation, or third-party rights
• Transmit malware, viruses, or any code designed to disrupt or damage the Service
• Share your account credentials or allow third parties to access your account without authorization
• Submit fabricated security event data with the intent to mislead or corrupt analytics
• Use the Service to collect, store, or process data in a manner that violates data protection regulations

5. Data and Security Events

You retain ownership of all security event data transmitted to the Service from your applications. By using the Service, you grant us a limited license to process, store, and analyze this data solely for the purpose of providing the Service to you.

We may use aggregated, anonymized data derived from security events to improve threat detection algorithms and overall Service quality. This aggregated data will not identify you, your organization, or your end users.

6. Intellectual Property

The Service, including its software, design, documentation, and all related intellectual property, is owned by Guard Core and protected by copyright, trademark, and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.

The open-source components of Guard Core (the open-source libraries) are governed by their respective open-source licenses. These Terms of Service apply specifically to the hosted platform and SaaS offering.

7. Service Availability and SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for any downtime, data loss, or damages resulting from service interruptions, whether planned or unplanned.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Guard Core and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

The Service is a monitoring and detection tool. We do not guarantee that the Service will detect all security threats, and we are not responsible for security incidents that occur in your applications regardless of whether the Service detected them. You remain solely responsible for the security of your own applications and infrastructure.

9. Termination

Either party may terminate this agreement at any time. You may stop using the Service and request account deletion at any time. We may suspend or terminate your access to the Service if you violate these terms, fail to pay applicable fees, or if required by law.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period (up to 30 days) to allow for data export, after which it will be permanently deleted in accordance with our data retention policy.

10. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to attempt informal resolution of disputes before initiating any formal proceedings.

11. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you through the Service or via email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Service.
